Sony &amp; Nintendo \u2014 Statutory \u00a7112(f), DOE\/FWR, and the Doctrinal Inversion<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Genuine Enabling Technology LLC (GET) owns U.S. Patent No. 6,219,730, which discloses a <strong>logic\u2011design structure<\/strong> that performs a <strong>single, inseparable dual function<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>synchronizing the user input stream with the input stream, and<\/li>\n\n\n\n<li>encoding the same into a combined data stream<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A person of ordinary skill in the art (POSITA) will implement this functional block using standard integrated\u2011circuit (IC) technologies\u2014ASICs, gate arrays, programmable logic devices, or microprocessor\u2011based design\u2014in place of the gate\u2011level example shown in the patent<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">GET brought infringement actions against Sony and Nintendo in separate district courts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Sony (D. Del.)<\/strong> \u2014 summary judgment of non\u2011infringement; affirmed by the Federal Circuit.<\/li>\n\n\n\n<li><strong>Nintendo (W.D. Wash.)<\/strong> \u2014 the court recognized that the disclosed logic\u2011design block (Block 34) is a complete, enabled structure understood by a POSITA and rejected Nintendo\u2019s indefiniteness challenge.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Three PTAB panels likewise recognized the same structure when denying IPR petitions filed by Sony and Nintendo.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>The Central Legal Issue<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This case presents a fundamental question under <strong>35 U.S.C. \u00a7112(f)<\/strong>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>May courts import the doctrine of equivalents and the Function\u2011Way\u2011Result test into the statutory \u00a7112(f) claim\u2011construction stage, thereby requiring a \u201cway\u2011by\u2011which\u201d analysis and gate\u2011level detail before allowing any structural comparison?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The lower courts effectively answered <strong>yes<\/strong>. The statute, Supreme Court precedent, and Federal Circuit precedent say <strong>no<\/strong>.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>The Doctrinal Inversion<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>By importing DOE and the Function\u2011Way\u2011Result test into the statutory \u00a7112(f) claim\u2011construction stage, the lower courts inverted the required sequence of analysis and effectively prevented the patentee from presenting infringement at the fact\u2011finding trial stage \u2014 the only stage where DOE\/FWR properly applies and where factual determinations of equivalence or potential copying can be made.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This inversion is the root cause of every downstream error.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Where the Lower Courts Went Wrong<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The lower courts departed from the statutory framework in seven ways. Each error is a <em>symptom<\/em> of the same doctrinal inversion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>1. Misidentifying the Statutory Function<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The claim recites a <strong>single dual function<\/strong>: <strong>synchronizing and encoding<\/strong> two data streams.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The courts isolated only \u201csynchronizing,\u201d treating it as a standalone function. \u00a7112(f) requires using the function <strong>as recited<\/strong>, not a judicially narrowed version.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. Expanding the Function by Importing Extra Components<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The courts treated the oscillator, clock generator, and flip\u2011flops as if they were required elements of the claimed function\u2014even though:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the claim does <strong>not<\/strong> recite them,<\/li>\n\n\n\n<li>the specification does <strong>not<\/strong> require them, and<\/li>\n\n\n\n<li>the PTAB and W.D. Wash. rejected this interpretation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This expansion distorted both the statutory function and the corresponding structure.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Faulting GET for Not Analyzing \u201cWays\u201d of Components Outside the Function<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Because the courts misidentified the structure, they then faulted GET for not performing a Function\u2011Way\u2011Result analysis on components that <strong>do not belong<\/strong> to the corresponding structure under \u00a7112(f).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This reverses the statutory sequence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Demanding Gate\u2011Level Detail and Internal \u201cWays\u201d Before Allowing Structural Comparison<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The courts required GET to enumerate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the \u201cway\u201d of each internal element,<\/li>\n\n\n\n<li>the \u201cway\u201d of the accused structure,<\/li>\n\n\n\n<li>gate\u2011level circuitry not disclosed in the patent.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is the <strong>mechanical dissection<\/strong> approach that <em>Odetics<\/em> expressly forbids.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Refusing to Evaluate the Corresponding Structure as a Whole<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Odetics<\/em> requires evaluating:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the <strong>disclosed structure as a whole<\/strong>,<\/li>\n\n\n\n<li>at the level of detail the patent provides.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The courts did not evaluate the disclosed logic\u2011design block (Block 34) as a whole. Instead, they:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>isolated sub\u2011functions,<\/li>\n\n\n\n<li>imported extra components,<\/li>\n\n\n\n<li>demanded internal \u201cways,\u201d<\/li>\n\n\n\n<li>and used the absence of this improper analysis to deny literal infringement.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. Using FWR as a Gatekeeper Instead of a Comparison Tool<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">DOE\u2019s Function\u2011Way\u2011Result test is a <strong>judicial infringement doctrine<\/strong>, not a claim\u2011construction tool. It belongs at <strong>trial<\/strong>, not at claim construction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By using FWR as a <strong>threshold requirement<\/strong> in the structural analysis, the courts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>collapsed \u00a7112(f) into DOE,<\/li>\n\n\n\n<li>eliminated the statutory pathway for literal infringement,<\/li>\n\n\n\n<li>contradicted <em>Graver Tank<\/em>, <em>Warner\u2011Jenkinson<\/em>, <em>Odetics<\/em>, and <em>WMS Gaming<\/em>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. Why the Issue Matters<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If this doctrinal drift is allowed to stand, it would:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>eliminate the statutory pathway for literal infringement under \u00a7112(f),<\/li>\n\n\n\n<li>force patentees to disclose gate\u2011level circuitry for logic\u2011design inventions,<\/li>\n\n\n\n<li>undermine the engineering discipline of logic design,<\/li>\n\n\n\n<li>create inconsistent outcomes between tribunals,<\/li>\n\n\n\n<li>and narrow \u00a7112(f) to the point of practical extinction.<\/li>\n<\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Procedural Posture<\/strong><\/h1>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Federal Circuit judgment entered<\/li>\n\n\n\n<li>Cert petition deadline: <strong>July 22, 2026<\/strong><\/li>\n\n\n\n<li>Document repository available <strong>July 3, 2026<\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Overview GET LLC v.
